Terms of Use and Conditions

1. GENERAL PROVISIONS AND ACCEPTANCE

These Terms of Use and Conditions ("Terms") constitute the entire agreement regarding the Nori app and web services ("Service" or "Services").

By downloading, installing, or using Nori, you are deemed to have fully accepted these Terms. If you do not accept the Terms, please do not use the Services.

Nori may modify these Terms at any time. You will be notified by email in the event of material changes. Continuing to use the Services after amended Terms take effect means you accept the new Terms.


2. SERVICE SCOPE AND DESCRIPTION

2.1 Description of the Service

Nori is a memory/map app that includes the following features:

  • Recording your memories with photos, text, and instant location data
  • Visualizing your memories on a map
  • Sharing your memories with friends
  • Location-based memory search and filtering
  • Social features (following, comments, likes)

2.2 Type of Service

The Service may be offered on the following platforms:

  • iOS and Android mobile app
  • Web app (nori.app or similar domain)
  • Desktop app (in the future)

2.3 Experimental Features

Nori may offer features marked as "Beta," "Experimental," or "Pilot." These features:

  • May not be fully supported
  • May contain bugs
  • May be removed without notice
  • May result in loss of your data

If you use experimental features, you accept that we have informed you of these risks.


3. AGE REQUIREMENTS AND ACCOUNT ELIGIBILITY

3.1 Age Limit

You must be at least 13 years old or the age of legal capacity in your country to use Nori.

3.2 Parental/Guardian Consent

If you are between 13 and 18 years old, you need the consent of a parent or guardian. Parents are responsible for their children's use of Nori.

3.3 Account Eligibility

By creating a Nori account, you represent that:

  • You are of legal age to enter into a contract
  • All of your information is accurate
  • You will use the Services for lawful purposes

If you provide false information, your account may be closed and your access to the Services may be permanently terminated.


4. ACCOUNT CREATION AND SECURITY

4.1 Account Creation Process

To create a Nori account:

  • Provide a valid email address
  • Set a secure password
  • Accept the Privacy Policy
  • Click the verification email link

4.2 Username and Email

  • Uniqueness: Every username and email address must be unique
  • Suitability: Offensive, insulting, or unlawful usernames are not permitted
  • Changing: Usernames can be changed from settings (restrictions may apply)

4.3 Account Security and Responsibility

You are responsible for:

  • Keeping your password confidential
  • Preventing access by others
  • Monitoring all activity on your account
  • Reporting unauthorized access immediately

Nori is not responsible for:

  • Theft or loss of your passwords
  • Damages resulting from unauthorized access
  • Accounts opened by other people
  • Phishing attacks

4.4 Password Reset

If you forget your password:

  1. Click the "Forgot Password" link
  2. Your email will be verified
  3. A reset link will be sent
  4. Set a new password

The reset link is valid for 24 hours. Do not share the link.


5. USER CONTENT AND OWNERSHIP

5.1 Definition of Content

"User Content" is anything you upload, share, or store within the Service:

  • Photos and videos
  • Text descriptions and stories
  • Location data
  • Comments and reactions
  • Profile information

5.2 Ownership of Content

  • Yours: You own all content you upload
  • License: To provide the Service, you grant Nori a worldwide, royalty-free, perpetual license to use, display, store, and process your content
  • Withdrawal: When you delete your account, this license to Nori ends (except for the 30-day backup period)

5.3 Content Sharing Options

Nori offers three sharing levels:

You can change your sharing settings at any time. Previously shared content is not retroactively affected by a new setting; you must update it manually.

5.4 Right to Copy and Reference

Content shared publicly:

  • Can be saved by other users (screenshot)
  • May be analyzed by Nori for consistency, relevance, and security checks
  • May be shared if requested by legal authorities

However, no one may reproduce or sell another person's content for commercial purposes.

5.5 Complaints and Copyright

If you find a copyright infringement or other rights violation, report it to info@getnoriapp.com. Provide details of the infringement and include the necessary evidence.


6. PROHIBITED CONDUCT AND MISUSE

6.1 Examples of Misuse

You agree not to do the following:

Identity Theft and Fraud:

  • Impersonating someone else
  • Providing misleading profile information
  • Opening an account for deceptive purposes

Security Violations:

  • Testing or bypassing the Service's security systems
  • Reverse engineering or attempting to extract source code
  • Discovering vulnerabilities and exploiting them without disclosure
  • Unauthorized access to others' accounts

Malware and System Attacks:

  • Sending viruses, worms, trojans
  • DDoS attacks intended to crash the Service
  • Distributing spam or bot software
  • Attempting to control someone else's device

Harassment and Threats:

  • Threatening or blackmailing other users
  • Sexual harassment or degrading behavior
  • Repeated disturbance despite warnings
  • Inciting hate speech

Unlawful Content:

  • Selling drugs, weapons, or stolen goods
  • Content depicting violence, abuse, or organized crime
  • Supporting or organizing terrorism
  • Child exploitation content is strictly prohibited

Commercial Misuse:

  • Using Nori for commercial purposes without permission
  • Web scraping
  • Mass automated account creation
  • Attempting to replicate Nori for competitive purposes

6.2 Detection and Enforcement

If prohibited conduct is detected:

  • Warning: First minor violation → email warning
  • Account Suspension: Repeated violation → 1-30 day suspension
  • Permanent Ban: Serious violation → account permanently deleted

An appeal against a permanent ban may be made to info@getnoriapp.com within 30 days.


7. SERVICE TERMS AND LIMITATION OF LIABILITY

7.1 Service "As Is"

Nori's services are provided "AS IS." Nori does not guarantee:

  • That the Service will be uninterrupted or error-free
  • That it will be fit for particular purposes or uses
  • That data will not be lost
  • That the Service will be secure
  • That performance will be at a certain level
  • That data loss will not occur (users should keep their own backups)

7.2 Planned Maintenance and Downtime

Nori may temporarily shut down the Service to update systems and perform maintenance:

  • Planned maintenance: notice given 24 hours in advance
  • Emergency maintenance: may be shut down immediately
  • Data loss: data preservation is not guaranteed during these periods

7.3 Service Quality

Nori commits to providing the Service with "reasonable effort," but:

  • Is not responsible for network errors or delays
  • Is not responsible for errors of third-party providers (Google, etc.)
  • The Service may be interrupted due to force majeure events (natural disaster, war)

7.4 Data Loss Liability

Nori protects data with maximum effort, but:

  • Cannot be held liable for data loss
  • Does not guarantee recovery of deleted data (except the 30-day backup)
  • Is not liable for damages due to technical failures or hacking attacks
  • Backing up data is the user's responsibility

7.5 Limitation of Damages

Nori's liability for any reason is limited to:

  • The total amount you paid to Nori in the last 12 months, or
  • €100, whichever is less

7.6 Indirect Damages

Nori cannot be held liable for:

  • Loss of revenue
  • Loss of profit
  • Economic damages resulting from data loss
  • Claims for moral damages
  • Claims from third parties

8. GOVERNING LAW AND DISPUTE RESOLUTION

8.1 Governing Law

These Terms are governed by the laws of the Republic of Türkiye. Relevant laws include:

  • Turkish Civil Code
  • The Law on the Regulation of Electronic Commerce
  • The Law on the Protection of Consumer Rights
  • KVKK and GDPR (for personal data)

8.2 Court Jurisdiction

Disputes will be resolved in the Courts of Istanbul. However:

  • If you reside in an EU country, you may choose your own country
  • If you are a consumer, the court of your location has jurisdiction

8.3 Mediation and Settlement

In the event of a dispute:

  1. Direct Negotiation: Seek a resolution with Nori within 30 days
  2. Mediation: A party that does not accept a settlement may apply to a mediator
  3. Litigation: If mediation is unsuccessful, the matter proceeds to court

8.4 Consumer Protection Bodies

If you are a consumer in Türkiye:

  • You may apply to the Consumer Arbitration Committee
  • You may file a complaint with the Consumer Protection Association (TÜKET)

9. TERMINATION AND SEVERABILITY

9.1 Service Termination

Nori may terminate the Service under the following circumstances:

At Your Request: Deletion request from account settings

Nori's Decision:

  • Violation of the Terms
  • Legal obligations
  • Technical reasons (shutdown of the service)
  • Long-term inactive account (1+ year)

9.2 Termination Procedure

If your account is to be deleted:

  • Notice is given 7 days in advance (exception: legal request/serious violation)
  • You are given a chance to back up your data
  • Permanently deleted after 30 days
  • There is no way to recover after deletion

9.3 Responsibility After Deletion

After an account is deleted:

  • Nori accepts no responsibility
  • Previous data cannot be used
  • Complaints regarding the deleted profile are not accepted

9.4 Surviving Provisions

Even after these Terms end, the following continue to apply:

  • The parties' legal obligations
  • Provisions intended to survive termination
  • Financial and copyright arrangements
